Legal consequences for those with and without formal risk management systems were highlighted at a TruckSafe information session in Wodonga on Tuesday night, 1 September 2026.

Around 35 compliance managers, business owners and staff learned about the new heavy vehicle laws and how Safety Management Systems help companies stay compliant.

TruckSafe Vice Chair Graham Emery told attendees the different outcomes from two worker accidents at companies he worked at with and without formal risk management systems.

“In 1999 there was a mechanic tragically killed on one of our sites while working across a jack,” Mr Emery said.

“Because there wasn’t a formal risk assessment in place the company was fined $150,000 and had to pay an additional $150,000 in court costs and the equipment manufacturer was also fined.

In another example an employee suffered an electric shock and was badly injured, Mr Emery said.

“In the investigation the company was not prosecuted as they had a formal written risk assessment process in place, which identified the specific risks involved.”

TruckSafe Chair Paul Fellows said one of the questions in the panel session included whether accreditation was necessary.

“The statistics show accredited operators have less accidents and less insurance claims,” Mr Fellows said.

“If something goes wrong and you do go to court, the magistrates can take into account you’re part of a voluntary accreditation scheme,” he said.

Hume Transport Operations Manager Campbell Elliott attended the event with two staff members and said it was a valuable opportunity to connect with others, hear about challenges and opportunities and share ideas.

“We’ve been with TruckSafe for 28 years and came away with new insights on how to strengthen our safety management system as we move into the Heavy Vehicle Accreditation phase,” Mr Elliott said.

Attendees heard from Graeme Cooper and Gerald Horkin from the National Heavy Vehicle Regulator as well as TruckSafe Board Members Glyn Castanelli and Peter Callanan.
